Problem

In no more than 250 words, describe the problem, who is affected, and the current ramifications. Explain the consequences if the issue continues.

E-cigarette use has become popular among teenagers because of aggressive marketing of the products, perception of safety, and availability of flavoured formulations (Kong & Krishnan-Sarin, 2017). In 2020, approximately 20% (3 million) of high school students and 5% (550,000) of middle school students were actively using e-cigarettes. Among these active users, 39% used e-cigarettes for at least 20 out of the past 30 days (Wang et al., 2020). Although these products are less toxic than conventional cigarettes, e-cigarettes have distinct health effects that make them comparably harmful. Besides the known association between the product and lung injury, recent evidence also shows that the flavouring in e-cigarettes is cardiotoxic (Abou-Assali et al., 2020). Over the past 2 years, lung diseases resulting from the vaping of e-cigarettes have caused significant morbidities and deaths involving teenagers. If the current trend is not contained, an epidemic of pulmonary and cardiac morbidities among teenagers may be witnessed in the coming years. Additionally, since e-cigarette use among adolescents is associated with subsequent heavy cigarette smoking and substance use tendencies (McCabe et al., 2018), substance use disorders and their negative mental health, physical health, and socio-occupational effects may become prevalent among teenagers.
Idea for Addressing Solution

In no more than 250 words, outline your idea for addressing the issue and explain why legislation is the best course for advocacy.

In order to end teenage e-cigarette use, legislation should be passed to require the possession of a renewable and revocable state-issued limited retail license for e-cigarette sale, for which the seller will be eligible after successfully completing mandatory prelicensure merchant education on the known short-term and long-term health risks of e-cigarette use among teenagers, and signing an agreement to comply with youth e-cigarette access law. License validity will be subject to continued compliance with the youth access regulations, while non-adherence will attract retail license revocation and prosecution.

Current legislation regulating e-cigarette access among the youth have failed to control the e-cigarette use epidemic in Florida because of inadequate compliance with measures for restricting youth access, such as stringent age verification (Public Health Law Center, 2020). Among states that have passed youth access laws, Florida is one of the leading states in underage e-cigarette retail violations (Sussman et al., 2020). Additionally, minimum-age regulations have also failed to yield a significant decrease in e-cigarette use among high school and middle school students in Florida (Ferrell et al., 2020).

Evidence 1 Licensure regulations are associated with a lower risk of e-cigarette use initiation among youth aged between 18 and 24 years compared to other state regulations such as special taxation, minimum age policies, and packaging restrictions (Jun & Kim, 2020).
Evidence 2 Underage sale violations are more frequent in the State of Illinois, which does not have retail license legislation, and less frequent in California and New York states, which have retail license legislation (Sussman et al., 2020; Public Health Law Center, 2020).

These stakeholders would oppose the introduction of e-cigarette retail license legislation because of the impact of such legislation on product retailer density and the consequent reduction in e-cigarette retail revenue.

In order to address this concern, I would argue that the aim of retail licensing is to enhance regulatory compliance in light of the raging e-cigarette epidemic arising in part from the actions of irresponsible retailers and distributors and that the legislation does not seek to abolish business.

Stakeholder(s) Opposed 2 Addiction treatment and substance use rehabilitation service providers who prescribe e-cigarettes as a harm reduction strategy for adult nicotine dependence may be opposed to the retail licensing legislation because it may potentially reduce access to e-cigarette products by their clients.

In order to address this concern, I will explain that while the use of e-cigarettes for harm reduction may be effective in adult nicotine addiction treatment, unregulated e-cigarette retail practices may be replacing adult nicotine dependence with teenage pulmonary and cardiac morbidities and deaths.

Financial Incentives/Costs

In no more than 250 words, summarize the financial impact for the issue and the idea (added costs, cost savings, increased revenue, etc.). Provided support.

E-cigarette retail licensing may result in a significant increase in state revenue through license registration and renewal fees, and fines obtained from retailers violating retail regulations such as minimum age policies.

Added costs may arise from the provision of funding to offer prelicensure and ongoing merchant education on the health effects of teenage e-cigarette use, including hiring and training of state educators. However, part of this cost may be offset using the revenue obtained from licensing fees.

Revenue from sales tax may reduce because of the potential reduction in retailer density following the implementation of a stringent licensing policy.

Major cost savings may arise from the reduction in the number of teenagers enrolled in nicotine and substance dependence rehabilitation programs, because of the reduced incidence of e-cigarette use initiation following the implementation of retail licensing requirements.

Christian Principles and Nursing Advocacy

The principles of social justice are foundational in Christian teachings and are echoed in the Biblical verse, “…Christ Jesus who died–more than that, who was raised to life–is at the right hand of God and is also interceding for us” (New International Version Bible, 1978/2011). Accordingly, engaging in legislative advocacy is consistent with these Christian teachings since the endpoint of legislative efforts is the realization of justice for vulnerable individuals or groups who do not have the capacity to advocate for themselves. Legislative advocacy provides the forum for exercising the Christian principles of love and compassion through participation in efforts to promote public policies that uphold the well-being of every member of society, especially disadvantaged individuals. Christians ought to emerge and articulate their opinions in matters regarding the well-being of other members of society.
