Explanation of the Policy

The 21st Century Cures Act is a law enacted in December 2016 by the 114th U.S. Congress, authorizing approximately $6.3 billion in federal support, primarily for the NIH (Mukherjee, 2016). In particular, the legislation brought forth a more effective means for non-profits and SMEs to deliver health insurance to their workers (HHS.gov, n.d.). It is commonly known as QSEHRA and permits small firms to allocate a fixed sum of money every month that workers can utilize to acquire personal health insurance cover, without tax. Among the law’s many provisions, the 21st Century Cures Act stipulated that employers must implement EHR information blocking (Levin, 2016).

The Impact of the Policy/Regulation of System Implementation

The law identifies interoperability and prohibits the blocking of information. The Act defines information blocking as a process of preventing or interfering with access to EHR – that is, data about an individual’s treatment history or medical history. Information blocking, under Section 4004, can attract fines of up to $ 1 million for each offense (Black, Hulkower, & Ramanathan, 2018).
